Vietnam aims to build modern legal system to drive growth and innovation

VOV.VN - The Politburo of the Communist Party of Vietnam has set a goal of building a modern, transparent and flexible legal system that can guide development, foster innovation and provide a foundation for the country’s strong economic growth in the coming period.

The orientation is outlined in the Politburo’s Conclusion No. 17 on legislative priorities for the 16th National Assembly term, signed by Tran Cam Tu, Politburo member and Permanent member of the Secretariat of the Communist Party of Vietnam Central Committee.

According to the Conclusion, legislative work during the 16th National Assembly term is identified as a key task to establish a legal framework for socio-economic development in the 2026–2031 period, aligned with the country’s long-term development strategy.

By 2030, Vietnam aims to build a legal system that is democratic, fair, consistent, transparent and enforceable, enabling stronger participation from citizens and businesses in socio-economic development.

Looking further ahead to 2045, the legal system is expected to reach a high level of quality and modernity, aligned with domestic realities and approaching international standards, meeting the requirements of a developed nation.

A key legislative priority is to comprehensively review practical implementation with a view to amending the 2013 Constitution to better align with the country’s evolving development needs.

This process is seen as a foundational step toward building a coherent and unified legal system, creating a basis for institutionalising major Party policies and supporting the transition to a new growth model.

A central priority is to fundamentally reform the approach to lawmaking, shifting from administrative control to a development-oriented, service-driven model that places citizens and businesses at the centre.

The Conclusion calls for abandoning the “if it cannot be managed, prohibit it” mindset, instead embracing controlled risk-taking and institutionalising regulatory sandboxes to expand space for innovation.

It also emphasises the need to establish legal frameworks for emerging sectors such as the digital economy, artificial intelligence, digital transformation, green transition and renewable energy, identifying them as key growth drivers in the coming period.

The Politburo has urged efforts to remove legal bottlenecks to fully mobilise resources for development and support high economic growth in the new phase.

This includes eliminating “ask–give” mechanisms, simplifying administrative procedures and business conditions, and creating an open, transparent and secure legal environment to attract investment.

The legal system is expected to serve not only as a governance tool but also as a resource and a source of national competitive advantage.

Legislative work is also tasked with supporting the establishment of a new growth model, restructuring the economy and advancing industrialisation and modernisation.

Science, technology, innovation and digital transformation are identified as core drivers, requiring the legal system to take the lead in enabling and guiding these processes.

Alongside promoting development, the conclusion stresses the need to ensure discipline in lawmaking, strengthen power control, enhance accountability and prevent corruption, waste and vested interests.

Agencies across the political system are required to raise responsibility, particularly leaders, in directing and implementing legislative work.

The National Assembly, its Standing Committee and relevant bodies are tasked with further reforming legislative processes and strengthening oversight of legal document drafting and issuance.

The Government is required to step up direction, supervision and inspection to ensure the quality and progress of draft laws, while improving procedures for developing and promulgating legal documents.
