New decree facilitates Vietnamese nationality registration

The Government has issued a new decree detailing and guiding the implementation of the Law on Vietnamese Nationality, creating more favourable conditions for Vietnamese residing abroad to retain their Vietnamese nationality. 

Decree 97/2014/ND-CP gives amendments and supplements to a number of articles in Decree 78/2009/ND dated on September 22, 2009. 

Under the new decree, overseas Vietnamese, who have not yet lost their Vietnamese nationality as prescribed by Vietnamese law before July 1, 2009, without any proofs of Vietnamese nationality shall make registration with an overseas Vietnamese representative agency to identify their Vietnamese nationality and to be issued Vietnamese passports following prescribed procedures in order to keep their Vietnamese nationality. 

Vietnam’s diplomatic missions, consular offices or other agencies authorised to perform consular functions in foreign countries where requesters are residing will accept and handle requirements on Vietnamese nationality registration and passports. 

In the case that requesters living in countries or territories without a Vietnamese representative office should submit their dossiers to a Vietnamese representative agency at their convenience.

A list of Vietnamese representative missions is available at portals of the Foreign Ministry and Justice Ministry, said the decree.

The new decree takes affect from December 1, 2014.
