Party leader To Lam urges removing legal obstacles to development

VOV.VN - Party leader To Lam asked the Ministry of Justice to help remove legal obstacles and barriers in order to unlock resources for national development, during his working session with the Party Civil Affairs Committee of the Ministry in Hanoi on November 7.

Speaking at the meeting, To Lam praised the Ministry of Justice for its sound performance in recent years, but pointed out that the lawmaking process still has shortcomings and limitations that need to be addressed soon.

According to the Party chief, some major guidelines and directions of the Party have not been implemented in a timely and complete manner. The quality of lawmaking has not met practical demands, with some newly enacted laws already requiring amendments.

In addition, regulations are not entirely coherent and often overlap, with many provisions still unclear, redundant, and obstructive to implementation, leading to wasted resources and inefficiencies. The legal environment has not created enough conditions to foster innovation or attract both domestic and foreign investors, nor has it effectively mobilized resources from the public.

The Party General Secretary emphasized the crucial role, position, and importance of lawmaking, highlighting its key significance in seizing opportunities, mobilizing resources for development, and improving the well-being of the people.

It is no coincidence that since the 12th National Party Congress, the Party has identified a breakthrough in the legal system, particularly legal reforms, as a strategic breakthrough, he reminded.  

To ensure the country confidently enters the new era and achieves the strategic goals set by the Party, he said the current urgent situation demands that the lawmaking process be elevated to a new level, truly becoming a powerful driver for development.

To this end, he suggested addressing legal bottlenecks and obstacles caused by existing laws in the lawmaking process, taking into account the practical development of Vietnam.

Lawmaking should focus on new issues and urgent practical challenges that lack legal regulations, as well as new Party guidelines that have not yet been institutionalized, he said.

It should aim to remove legal bottlenecks, quickly mobilize wasted resources, and establish a legal foundation for creating new growth drivers, new production relationships, new industries, and new forces of production, he added.

In addition, he suggested that the lawmaking program should focus on building a legal framework for emerging issues and new trends, such as artificial intelligence, digital transformation, and green transition.

With regard to legal appraisal and the drafting of legal documents, the General Secretary emphasized the necessity of preventing ‘interest groups’ from influencing legal processes. He stressed the importance of comprehensive legal evaluations, taking into account all factors, especially security concerns, to avoid negative impacts on national interests and people’s rights.

The General Secretary also underscored the importance of developing human resources for legal advisory work, particularly those involved in lawmaking. He stressed the need to enhance the responsibility of participating in international integration and in the development of international law, with a focus on protecting national interests.
