Some draft laws under NA discussion
(VOV) - On June 18, National Assembly (NA) deputies discussed the draft law on the organization of criminal investigation agencies that is expected to be adopted at the National Assembly (NA) year-end session.
The draft law covers human rights and citizen’s rights regulated in the 2013 Constitution and judicial affairs. Lawmakers underlined the need to provide security agencies with authority to investigate terrorists and crimes relating to funding for terrorists.
According the draft law on the organization of criminal investigation agencies and the revised law on criminal procedure code, fisheries surveillance agencies, taxation agencies and the State Securities Commission will be assigned to conduct investigations into fisheries. But most deputies disagreed with this adjustment.
To prevent and combat crimes relating to smuggling, fake goods, and infringements of intellectual property, NA Deputy Tran Ngoc Vinh of Hai Phong City said, The Public Security Ministry has recently established an anti-smuggling police department specializing in tackling smugglers, fake products, and trading fraud. But there aren’t regulations on stipulation of the department’s function of investigation, proceedings, and authority for imposing administrative fines.
I suggest the compiling board soon supplement these functions and mission of the anti-smuggling police department to the revised law on the organization of criminal investigation agencies. Anti-smuggling police departments should be set up in a number of key provinces and cities where smuggling, fake goods, and infringements of intellectual property are complicated.'
The same day, NA deputies also discussed the draft law on custody and temporary detention. During the draft law compilation process, the Ministry of Public Security collected the opinions of people and related ministries and sectors regarding the draft law and also took into consideration the Ministry of Justice’s assessment of it.
They suggested that detention centres should be built separately from investigation agencies to ensure objectiveness during the investigation process. Do Ngoc Nen, a deputy from Binh Thuan province, talked about regulations applied to those in custody and temporary detention, "I propose amendments to the draft law to ensure the appropriate amount of food and basic necessities for people in custody and temporary detention. The government should create regulations regarding this matter. I suggest further research on physical exercise for people in custody and detention. Amendments need to include regulations over space and time, and the physical conditions of detention centres."
NA Deputies also voted to adopt the revised Law on Military Service and the Law on Veterinary.
