Ministry of Health orders stricter controls on illegal organ trade
VOV.VN - Vietnam’s Ministry of Health has instructed medical facilities nationwide to strengthen oversight of procedures for receiving donors and performing transplants of human tissues and organs, while firmly preventing brokerage, trading or illegal acquisition of organs and tissues.
The directive was outlined in an official dispatch recently sent to hospitals, provincial and municipal health departments, and medical facilities authorized to perform transplantation of human tissues and organs. The move aims to rectify compliance with regulations governing the donation, retrieval and transplantation of human tissues and organs.
The ministry said information from competent agencies and reports in the media indicate that illegal networks involved in brokerage, trading and illegal acquisition of human tissues and organs have emerged, operating through connections on social media platforms.
Such acts violate the law and also seriously affect medical ethics and the reputation of the healthcare sector, while posing risks to people’s health and lives.
To improve supervision in this area, the ministry requires relevant units to strictly comply with legal regulations governing the donation, retrieval and transplantation of human tissues and organs.
Medical examination and treatment establishments must fully observe the provisions of the Law on Donation, Removal and Transplantation of Human Tissues and Body Parts and Donation and Removal of Corpses, as well as other related legal documents and guidelines issued by the ministry during implementation.
The ministry emphasized that all forms of brokerage and trading of human tissues and organs are strictly prohibited. Heads of medical establishments will bear legal responsibility and accountability to the ministry if violations occur within their institutions.
Medical institutions are also required to intensify control over procedures for receiving donors and conducting transplantation of human tissues and organs.
Facilities performing organ transplants must review and promptly rectify management practices and professional procedures related to the donation, retrieval and transplantation of organs. They are required to fully carry out procedures for receiving, appraising and verifying the relationship between donors and recipients in accordance with legal regulations, particularly for cases involving donation of tissues or organs from living donors.
In addition, medical establishments must carefully review transplant documentation to ensure its legality, transparency and completeness. Transplants must not be carried out when documentation is incomplete or when there are suspicious signs related to illegal brokerage or trading.
At the same time, institutions are required to enhance professional ethics training and legal awareness for healthcare workers, especially those directly involved in tissue and organ transplantation activities.
The ministry also instructed provincial and municipal health departments to strengthen inspection and supervision of medical facilities performing transplantation of human tissues and organs in their localities, and to promptly detect, prevent and strictly handle violations in accordance with the law.
Localities are also asked to step up campaigns encouraging organ and tissue donation from brain-dead donors in order to increase legitimate donation sources and gradually reduce reliance on donations from living donors.
If signs of brokerage or trading of human tissues or organs are detected, medical facilities must promptly report to management agencies, while coordinating with competent agencies to verify and handle the cases in accordance with legal regulations.
