Foreigners who intentionally or unintentionally violate Vietnamese laws are likely to be expelled from Vietnam in accordance with administrative procedures, according to a decree recently issued by the Prime Minister.

The decree, which will take effect 15 days after it is published on the Official Gazette, will be applied to foreigners who intentionally or unintentionally offend Vietnamese laws and are liable to expulsion under regulations on resolving administrative violations.


Foreigners, who have commit crimes for which they are expelled according to a Court's decision, will not be subject to this decree.


But in cases where regulations under this decree conflict with an International Convention of which Vietnam is a member, the International Convention will prevail.

The decree stipulates the jurisdiction and procedures that must be followed to make a decision on expelling a person and to implement the decision. It also regulates the responsibility of ministries and municipal and provincial People's Committees in imposing the expulsion in accordance with administrative procedures.
