Every foreign fishing vessels operating in Vietnamese waters will be required to have a member of the Vietnamese authorities on board of June 1.
Under Prime Minister Nguyen Tan Dung’s recent decree on managing the operation of foreign fishing vessels in Vietnamese waters, foreign fishermen will have to apply for a license to fish in local waters.

The license will be valid for not more than 12 months for aquatic exploitation and 24 months for aquatic-related activities.

It will take between three and ten days for foreign fishermen to receive a license or have their license renewed or extended.

The decree also covers the rights and interests of foreign boat owners. They will receive regular weather updates from Vietnamese authorities as well as information on fisheries activities. They will also be informed of regulations when needed and be protected by the State of Vietnam while operating in Vietnamese waters.

However, they will have to pay for all related fees and inform the Ministry of Agriculture and Rural Development’s Fisheries General Department in written form a week before their boats arrive in Vietnamese waters.

Foreign fishermen must also complete entry procedures for Vietnam as regulated and bring with them related documents such as fishing licenses, boat registration certificates and technical safety registration certificates for their boats.

Particularly, they will be required to abide by all related regulations of Vietnam and international treaties that Vietnam has signed or joined.

The PM has also issued another decree managing the fishing activities of Vietnamese individuals and organisations within domestic waters, under which Vietnamese individuals and organizations involved in domestic fisheries must abide by regulations issued by the Ministry of Agriculture and Rural Development or provincial-level People’s Committees.

The decree also regulates the rights and obligations of Vietnamese individuals and organisations when fishing outside Vietnam ’s waters.

They are required to carry out all related exit and entry procedures in line with the laws of Vietnam and countries or regions in which they operate as well as international treaties that Vietnam has signed.

While operating in foreign waters, they will have to carry documents and licences provided by the host countries.

The decree will take effect as of June 15.
