Businesses urged to prepare for increasingly complex trade remedy measures

VOV.VN - Trade remedy cases against Vietnamese exports are increasing as the country deepens global economic integration and maintains strong export growth.

The trend requires regulators, industry associations and businesses to adapt in order to safeguard market share and growth targets.

According to the Trade Remedies Authority of Vietnam (TRAV) under the Ministry of Industry and Trade, Vietnamese exports have so far faced 293 trade remedy cases initiated by overseas markets.

The scope and complexity of these investigations are expanding quickly as some countries begin examining new issues with no previous precedent, extending beyond traditional export sectors.

Conversely, Vietnam has initiated 62 trade remedy investigations and is currently applying 37 trade remedy measures to imported goods. Products under investigation cover a wide range, including basic metals, chemicals and plastics, construction materials and several consumer goods.

Nguyen Hang Nga, deputy head of the Division for Trade Remedies in Foreign Markets at the Trade Remedies Authority of Vietnam, said trade remedy cases are becoming more complex as foreign investigating authorities continue to adjust their approaches and introduce new lines of inquiry. A single product may face several investigations. Vietnamese aluminum and steel products, for example, have been investigated for circumvention of trade remedy duties and later subjected to anti-dumping, anti-subsidy and additional circumvention investigations across different stages.

The scope of investigations is also expanding to lower-value products such as capsule shells, paper bags, plastic boxes, steel nails and molded fibers. This development shows that any export product may become subject to investigation, while foreign investigating agencies often require companies to provide extensive information, including detailed and sometimes sensitive data.

In a trading environment that is becoming more stringent and carries higher risks, Vietnamese enterprises are advised to strengthen trade remedy safeguards in order to reduce risks and protect export market share.

Nga said businesses should focus on several key measures, including diversifying export markets and supply sources to avoid dependence on markets that frequently initiate trade remedy actions. At the same time, greater transparency in accounting systems and clear product traceability are essential foundations for responding to investigations related to duty circumvention or origin fraud-trends that have increased in recent years.

Companies are also encouraged to prepare documentation, data and transparent accounting procedures, fully recording production and business costs as well as input materials. These steps help meet the strict requirements of foreign investigating authorities while improving corporate governance and competitiveness.

Bach Thang Long, Deputy General Director of May 10 Corporation, noted that export sectors experiencing rapid growth over a short period may face a higher risk of trade remedy actions from importing markets. In the garment industry, imported materials from China currently account for around 60%-70%, which could also pose a potential risk when products enter export markets.

Chu Thang Trung, deputy director of the Trade Remedies Authority of Vietnam, emphasized that companies should establish clear traceability systems, increase transparency in domestic value-added ratios, apply international accounting standards and raise the share of locally sourced inputs. These factors help demonstrate transparency during investigations and strengthen the competitiveness of Vietnamese goods in global supply chains.

According to Trung, foreign investigating agencies often require highly detailed documentation and compare it directly with accounting data during trade remedy investigations. When management and accounting systems are standardized from the outset, corporate credibility improves, thus helping companies better defend their legitimate interests in trade disputes while reinforcing the reputation of Vietnamese exports in the international market.
