On August 21, 2006, the third conference of the 10th Party Central Committee adopted Resolution 04-ND/TW on “Strengthening the Party leadership in the fight against corruption and wastefulness”, showing the Party’s strong determination to crack down on these negative phenomena.

The resolution came hot on the heels of the Law on Anti-corruption which was passed by the National Assembly in 2006. Chapter II of the law examines several steps to ensure the success of the fight.

First, anti-corruption requires honest declaration of property among ranking officials. It is considered a primary step towards justifying transparency later, requiring a high consciousness of those subject to property declaration in line with the law. Without taking this step, it will be impossible to make an accurate assessment of property owners.

According to the law, those who are subject to property declaration must declare their property honestly and be responsible for their statement. But the question is how to measure the honesty of property owners and who will guarantee the honesty. The bottom line is that it is necessary to raise the awareness of implementing the law, particularly among ranking officials, and that Party members must play the leading role in this fight. The more honest the declaration is, the more transparent the justification is. Honest declaration will make it easier to crack down on areas where corruption is rampant.

Second, anti-corruption requires honest justification. The first move of justifying the owner’s property is to verify the validity of the declaration and the value of the property. This step must be undertaken with care due to the sensitivity of the issue. So it is imperative to take into account appropriate ways to justify the declaration with tactful behaviours and complete solutions to avoid careless mistakes. Honest justification will help property owners show consciousness in implementation of the law and help Party organisations and management agencies gain a better understanding and control of the economic conditions of their staff.   

Third, anti-corruption requires honest control. This is the last step in the whole process before drawing a conclusion and making an owner’s property and income status into public knowledge. This step is essential because honest declaration and justification are necessary in the fight against corruption. One issue involved in the declaration and justification process is that those is charge may want to avoid being the fault finders of the involved persons under scrutiny, thus making control of the declaration and justification process even more difficult.

The three steps are part and parcel of the entire fight against corruption and wastefulness. The goal of fighting corruption cannot be achieved without resorting to legal action.
