NA examines draft law on prevention and combating proliferation of WMD
VOV.VN - The National Assembly heard a summary submission and a summary verification report on the draft Law on Prevention and Combating of the Proliferation of Weapons of Mass Destruction (WMD) on August 4, as part of its first extraordinary session.
Authorized by the Prime Minister to present the summary Submission, General Phan Van Giang, Deputy Prime Minister and Minister of National Defence, stated that the research, drafting, and promulgation of the Law is an urgent requirement to institutionalize the Party's guidelines on protecting the Fatherland early and from afar, before any potential danger arises.
It aims to ensure national defense, security, scientific and technological development, and innovation; actively integrate into the international community; perfect the socialist rule-of-law state of Vietnam; and build a synchronous and unified legal system to address traditional and non-traditional security risks in the new context. Concurrently, it ensures the fulfillment of the country’s national commitments and obligations regarding the prevention and combating of the proliferation of weapons of mass destruction under international treaties to which Vietnam is a state party.
Regarding the scope of regulation and applicable subjects, the draft law stipulates the principles, measures, policies, resources, and responsibilities of agencies, organizations, and individuals in preventing and combating the proliferation of weapons of mass destruction. The draft law applies to Vietnamese agencies, organizations, and individuals, as well as foreign agencies, organizations, and individuals operating or residing in the territory of Vietnam.
The draft law consists of 4 chapters and 37 articles, built upon institutionalizing three policies approved by the Government under Resolution No. 130 dated May 18, 2026. Specifically, the first policy focuses on fine-tuning principles to ensure human rights and citizens' rights under the Constitution and international treaties. The second policy strengthens specific management and control measures over activities with potential risks of proliferation. Meanwhile, the third policy aims at perfecting organizational execution mechanisms and dedicated resources.
General Phan Van Giang noted that the draft law is structured as a framework law, regulating only foundational, long-term stable issues under the authority of the National Assembly. It does not codify highly technical, professional, or frequently changing matters, but delegates authority to the Government and competent agencies to provide detailed regulations to ensure flexibility, feasibility, and alignment with practical realities and relevant international commitments.
Presenting the summary Verification Report, Chairman of the Committee on National Defenvce, Security and Foreign Affairs, Senior Lieutenant General Le Tan Toi, said that the committee agreed on the necessity of enacting the Law to promptly institutionalize the Party's policy on protecting the Fatherland early and from afar, refining the legal framework on preventing and combating the proliferation and financing of proliferation of weapons of mass destruction, meeting practical demands, and fulfilling international treaties and UN Security Council resolutions to which Vietnam is a member.
The verifying agency asked the Government to direct further review of the full contents outlined in the verification report to revise and complete the draft Law, ensuring a deeper comprehension of the mindset on legislative innovation, as well as the consistency and synchronization of the draft law within the legal system. Furthermore, it recommended continued reviews of the national risk assessment mechanism, measures to prevent and combat the proliferation and financing of proliferation to guarantee national defence and security while facilitating socio-economic development, alongside state management work, the identification of national focal points, and forces participating in these effort.
